Native Grid Inc., a Delaware corporation (“Setka” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy. This Privacy Policy provides information on how we collect personal data, and how we use that data. This policy describes the types of information we may collect from you or that you may provide when you use the “Setka Editor” (the “Service”) and the web site located at editor.setka.io (the “Site”) as well as our Setka Editor solutions for various platforms (“Solutions”) as it defined in the Terms and our practices for collecting, using, maintaining, protecting and disclosing that information.

Our Terms of Service (“Terms”) is incorporated herein by reference and is available at https://editor.setka.io/terms/Terms-and-Conditions-Setka-Editor.pdf. All defined terms in the Privacy Policy shall have the same meaning as defined in the Terms.

By using our Services and the Site, you consent to the collection, transfer, storage disclosure, and use of your Information in the manner set out in this Privacy Policy. If you do not consent to the use of your Information in these ways, please stop using the Services and the Site.

Definitions

  • “Non-Personal Data” is information that is in no way personally identifiable and that is obtained automatically through your simple use of the Site with a web browser or the Service.
  • “Personal Data” is non-public information that is personally identifiable and obtained in connection with providing the Service to You.
  • “Non-Personal Data” and “Personal Data” are jointly referred to as the “Information” or “Data”.

The type of information we collect

We collect both Non-Personal Data zand Personal Data.

Personal Data

Personal Data is any information relating to identified or identifiable individual; meaning, information that could be used, on its own or in conjunction with other data, to identify an individual. We may ask for certain Personal Data from you for the purpose of providing you content and/or services that you request.

When you register in our Service, You must provide us the following information to create an account: name, email address, company name, domain name, credit card information.

Non-personal Data.

When you enter the Site, We collect Non-Personal Data such as your browser type and IP address.

Our Site may use certain cookies. Cookies are small text files placed on your device when you visit the Site, in order to track use of the Site. Cookies allow us to distinguish you from other users of our Service, which helps us to provide you with a good experience when you browse our website and also allows us to improve our Service. By visiting the Site or using the Service you agree to the use of cookies in your browser.

For our WordPress Plugin we also collect information about your WordPress version, your active WordPress theme and your plugin’s activation date.

In case you would like to connect our Service and your HubSpot account we also require an access to create new posts in blog and to Files API for local storage of files and styles, as well as your HubSpot blogs lists, Blog ID, Post ID.

Please note that we use Google Analytics in order to collect data about clicks on certain interface elements.

Transactional Information.

Certain features of the Service are available for a fee. In processing payment for such additional services we will collect certain information necessary to complete your purchase (“Transactional Information”). This information may include your name, billing address, email address, phone number, and credit card information, such as type of credit card, name on card, card number, validation number, and expiration date. We may retain Transactional Information as long as is necessary to fulfill the purposes specified in this Privacy Policy and for recordkeeping, subject to statutory or regulatory retention requirements and legitimate business needs. We may collect information related to your transactions performed using the Service (the “Transaction Data”). We may use your Transaction Data to improve your experience with the Service, including to deliver advertisements to your mobile communications device from third parties or merchants (with whom we have contracted).

Please be aware that we use Stripe to process payments. Your payment information and email is subject to their privacy policy.

Customer Data

We collect and store content that our Customers post, send, receive and share through the Service. This content includes any information about you that our Customers may choose to include.

We also provide our customer support, where you may choose to submit information regarding a problem you are experiencing with a Service. You will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving the issue.

Data security

We undertake commercially reasonable and industry-standard physical, managerial, and technical safeguards to preserve the integrity and security of your information. Personal Data and backups are stored in protected databases located behind a firewall and with both physical and software-based access controls.

Our Policy Toward Children Under 13 Years Of Age

The Service is not directed to children under 13 years of age. If you become aware that your child under 13 has provided us with personal information without your consent, please contact us at info@setka.io. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child’s account. By using the Service, you are representing to us that you are not under the age of 13. If you are under 13 years of age, you are not authorized to use the Service and must immediately delete the Plugin. We recommend that minors, who are 13 years old but under 18 years old, ask their parents or legal guardians for permission before sending any information about themselves to us or anyone else through the Service.

International Users

Your Personal Data may be stored and processed in any country where we have facilities, and by using the Service you consent to the transfer of your Personal Data to countries, including the United States, which may be outside of your country of residence and may provide for different and less stringent data protection rules than in your country. If you object to your Personal Data being transferred or used as described in this Privacy Policy, please do not use the Service.

EU Users (GDPR)

Data Processors and Data Controllers

All Customer information is owned and controlled by our Customers, who are the data controllers for such information with respect to EU data protection law. We store and process Customer Data on the basis of instructions from our Customers. If we receive a data subject request, we may point you in the direction of its Customer, as the Customer is the controller of the Customer Data. Where we act as a Data Processor to our Customers, we process the data collected through our Services only on behalf of our Customers, work strictly in accordance with their instructions as Data Controllers, and do not use any personal information for our own purposes.

Data Subject Rights

If you are an individual in the European Union (“EU”), we collect and process information about you only where we have legal bases for doing so under applicable EU laws. The processing of your data is either based on your consent or in case the processing is necessary for the performance of a contract to which you are a party, or in order to take steps at your request prior to entering into a contract, cf. GDPR art. 6(1)(a)-(b).

You have certain data protection rights. In certain circumstances, you have the following data protection rights:

  • The right to access, update or to delete the personal information we have on you

Where required under the GDPR, we shall maintain all records required by Article 30(2) and, to the extent applicable to the processing of Personal Data on behalf of Customer, make them available to Customer upon request.

California Privacy Rights

California residents are entitled to receive: (a) information identifying any third-party companies to whom we may have disclosed Personal Information to for direct marketing, within the past year; and (b) a description of the categories of Personal Information disclosed. To obtain such information, please use an email from the section Contact below and we will provide a list of categories of Personal Information disclosed within thirty (30) days after receiving such a request. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted in ways other than those specified above.

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months. You may make such request for access or data portability twice within twelve (12) month period. Once we receive and confirm your verifiable consumer request, we will disclose the following to you: (i) the categories of Personal Information we collected about you; (ii) the categories of sources for the Personal Information we collected about you; (iii) the business purpose for collecting (or selling, if applicable) the Personal Information; (iv) the categories of third parties with whom we share such Personal Information; and (v) the specific information we collected about you.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:
